Terms of Use and Nutrition Coaching Terms

 Effective Date: September 3, 2026
Last Updated: September 24, 2026

These Terms of Use and Nutrition Coaching Terms ("Terms") govern your use of the Healthy Habits Coaching website and, where applicable, nutrition coaching, educational services, digital materials, and related services provided by Healthy Habits Coaching ("Healthy Habits Coaching," "we," "us," or "our").

Please read these Terms carefully before using the website, purchasing a service, scheduling an appointment, accessing paid materials, or participating in coaching.

By using the website, purchasing or booking a service, or participating in coaching, you acknowledge that you have read and agree to these Terms and to any policies expressly incorporated into them. If you do not agree, do not use the website or services.

Nothing in these Terms excludes, restricts, or waives any right, remedy, duty, or liability that cannot lawfully be excluded, restricted, or waived under applicable law.

1. About Healthy Habits Coaching

Healthy Habits Coaching provides nutrition education, behavior-change support, lifestyle coaching, and general wellness education. Services are provided remotely and online.

Services are provided by:

Ori Scott, M.Sc. Nutrition
Registered Dietitian (Israel)
Nutrition Coach and Founder, Healthy Habits Coaching

The designation "Registered Dietitian (Israel)" identifies a professional credential held in Israel. It does not represent that Ori Scott holds New York State certification as a Certified Dietitian, Certified Nutritionist, or Certified Dietitian-Nutritionist.

Healthy Habits Coaching does not maintain a physical client consultation office and does not provide in-person consultations unless expressly agreed otherwise in writing.

2. Nature and Scope of Services

Healthy Habits Coaching may provide education and coaching concerning eating patterns, meal planning, food selection, nutrition literacy, behavior change, physical activity and lifestyle habits, weight management, and general nutrition-related wellness.

Where a client has a diagnosed medical condition, coaching may help the client understand and implement nutrition or lifestyle recommendations made by the client's physician or another appropriately licensed healthcare professional, within the lawful scope of the services being provided.

The nature, frequency, duration, content, and format of coaching may vary according to the service purchased, the information reasonably available, and the client's circumstances.

Healthy Habits Coaching may determine that a requested service, recommendation, or topic is outside the appropriate scope of coaching and may decline to provide it or may recommend evaluation by another qualified professional.

3. Professional Credentials and New York Disclosure

Ori Scott holds an M.Sc. in Nutrition and is a Registered Dietitian in Israel.

Healthy Habits Coaching does not represent Ori Scott as a New York State Certified Dietitian, Certified Nutritionist, Certified Dietitian-Nutritionist, physician, nurse practitioner, pharmacist, psychologist, or other New York-licensed healthcare professional unless such credential is expressly and accurately identified.

New York State restricts use of its certified dietitian/nutritionist titles to individuals certified by the New York State Education Department. New York State does not currently require that certification merely to perform nutritional counseling.

Nothing on the website, in social media, in educational content, or during coaching should be interpreted as a representation of a professional credential that is not expressly identified.

4. Educational Coaching; Not Medical Diagnosis or Treatment

Healthy Habits Coaching services are intended to support education, informed decision-making, behavior change, and implementation of appropriate nutrition and lifestyle strategies. They do not replace appropriate medical care.

Unless expressly provided by an appropriately licensed healthcare professional acting within an authorized scope, Healthy Habits Coaching does not diagnose disease, provide medical treatment, prescribe medication, independently start, stop, increase, decrease, or otherwise modify prescription medication, provide emergency medical services, or replace treatment by a physician or other qualified healthcare professional.

Information provided through the website, articles, recipes, videos, downloadable materials, messages, or coaching sessions must not be used as the sole basis to diagnose a disease or to change prescription medication.

If you have a medical condition, are pregnant or breastfeeding, take prescription medication, have a history of an eating disorder, have significant kidney, liver, cardiovascular, metabolic, or other disease, or otherwise require medical supervision, you are responsible for obtaining appropriate medical guidance before making material dietary, supplement, physical-activity, or lifestyle changes.

5. Medical Conditions, Medications, and Coordination of Care

Nutrition and lifestyle changes may affect medical conditions, symptoms, laboratory values, hydration status, blood glucose, blood pressure, body weight, medication requirements, and other aspects of health.

You must not independently stop, reduce, increase, or otherwise change prescription medication based on information provided by Healthy Habits Coaching.

Healthy Habits Coaching may require or recommend consultation, medical clearance, laboratory evaluation, or coordination with a physician or another appropriately licensed healthcare professional before or during coaching.

We may pause, limit, or decline a recommendation or service when we reasonably believe additional medical evaluation or professional oversight is appropriate.

You remain responsible for communicating relevant nutrition or lifestyle changes to your treating healthcare professionals when appropriate.

6. Emergencies and Urgent Concerns

Healthy Habits Coaching is not an emergency medical service and does not provide continuous medical monitoring.

Do not use the website, email, WhatsApp, Zoom, website forms, social media, or coaching services for a medical or psychiatric emergency.

If you believe you may be experiencing an emergency, call 911 in the United States or contact the appropriate emergency service in your location.

Messages may not be reviewed immediately. The absence of a response must never be interpreted as confirmation that a situation is safe or that medical attention is unnecessary.

7. Eligibility

Standard website and coaching services are intended for adults 18 years of age or older.

By purchasing, booking, or participating in adult coaching services, you represent that you are at least 18 years old and legally capable of entering into the applicable agreement.

Services for minors, if offered, require separate arrangements and appropriate involvement and authorization of a parent or legal guardian.

8. Client Responsibilities and Accuracy of Information

Nutrition coaching depends substantially on information supplied by the client. You agree to provide information that is accurate, complete, and current to the best of your knowledge and to notify Healthy Habits Coaching of material changes relevant to the services.

Relevant information may include diagnoses, symptoms, medications, supplements, allergies, intolerances, laboratory results, pregnancy, medical restrictions, prior adverse reactions, eating-disorder history, and recommendations made by your healthcare professionals when reasonably relevant.

Healthy Habits Coaching is entitled to reasonably rely on information you provide. To the maximum extent permitted by law, Healthy Habits Coaching is not responsible for an adverse consequence to the extent it is materially caused by information that you provided inaccurately, incompletely, misleadingly, or failed to disclose when reasonably relevant to the service.

You remain responsible for your healthcare decisions, for seeking appropriate medical care, for following emergency instructions, and for deciding whether and how to implement coaching information.

You agree not to knowingly participate in an activity that has been medically restricted or to continue an activity that produces concerning symptoms without obtaining appropriate professional guidance.

9. No Guarantee of Results

Nutrition, weight, metabolic, behavioral, and lifestyle outcomes vary substantially among individuals.

Results may be affected by medical conditions, medications, genetics, age, sleep, physical activity, adherence, environment, socioeconomic circumstances, changes in health status, and many other factors outside the control of Healthy Habits Coaching.

Healthy Habits Coaching does not guarantee any amount or rate of weight loss, blood-glucose improvement, laboratory change, disease outcome, medication reduction, symptom improvement, fitness change, behavior change, or other health or wellness result.

Testimonials, examples, case discussions, reviews, or client experiences do not guarantee that another person will achieve the same or similar results.

10. Changes in Evidence and Recommendations

Nutrition science, clinical guidance, product formulations, and individual circumstances can change. Information or recommendations are based on information reasonably available at the time they are provided.

A recommendation that was appropriate at one time may require modification if your health status, medications, laboratory results, goals, scientific evidence, or other relevant circumstances change.

Healthy Habits Coaching does not guarantee that previously provided educational content will remain current indefinitely.

11. Weight Management and Obesity

When weight management is discussed, Healthy Habits Coaching approaches obesity and body-weight regulation as complex issues influenced by biological, environmental, behavioral, social, and medical factors.

Services are not based on the premise that body weight reflects an individual's character, discipline, or personal worth.

Weight-management strategies may include nutrition, physical activity, behavioral approaches, and referral for medical evaluation or treatment when appropriate. No particular weight loss or body weight is guaranteed.

12. Supplements, Foods, and Nutrition Products

Discussion of vitamins, minerals, protein products, omega-3 fatty acids, fiber products, probiotics, herbal products, foods, or other dietary supplements is educational unless specifically individualized within the lawful scope of the service.

Discussion, mention, or linking of a product does not mean that it is appropriate, necessary, effective, or safe for every person.

Supplements and foods may cause adverse effects, allergies, intolerances, or interactions with medications or medical conditions. Product formulation, quality, labeling, and availability may change without notice.

Healthy Habits Coaching does not prescribe prescription medications and does not represent dietary supplements as substitutes for medically necessary treatment.

Any financial, affiliate, sponsorship, or other material relationship concerning a referenced product or company will be disclosed where required by applicable law.

13. Website and General Educational Content

Articles, recipes, videos, social-media posts, newsletters, downloadable materials, graphics, and other general content are provided for educational and informational purposes.

General content is not individualized professional advice and cannot account for your complete health history, medications, allergies, laboratory values, nutritional requirements, or other individual circumstances.

You should not rely on general content as a substitute for individualized medical evaluation or treatment where such care is indicated.

14. Food Allergies, Recipes, and Nutrition Estimates

Recipes and food suggestions are provided for general educational purposes unless expressly identified as part of an individualized service.

You are responsible for checking ingredients, labels, cross-contact risks, preparation methods, allergens, intolerances, religious or cultural restrictions, medication-food interactions, and other individual requirements.

Manufacturers may change ingredients, formulations, processing methods, and labeling without notice.

Calories, macronutrients, micronutrients, serving sizes, and other nutrition calculations displayed by Healthy Habits Coaching are estimates unless expressly stated otherwise and may vary according to ingredients, brands, portions, preparation methods, and calculation tools.

15. Online Services, Zoom, WhatsApp, and Electronic Communication

Healthy Habits Coaching is an online service. Sessions and communications may use Zoom, WhatsApp, email, website tools, scheduling services, payment processors, or other electronic platforms.

These services may be operated by independent third parties. Their availability, accessibility, privacy practices, security, updates, technical performance, and terms are outside our direct control.

Internet-based communication carries inherent risks, including interruptions, device or software failure, unauthorized access, transmission errors, delayed delivery, and other technical or security problems.

Healthy Habits Coaching will use reasonable measures appropriate to its services but does not guarantee uninterrupted service, error-free transmission, or absolute confidentiality or security of independent third-party systems.

A temporary technology failure or third-party outage outside our reasonable control does not by itself constitute a breach of these Terms. When reasonably practicable, we may reschedule or use an alternative communication method.

Clients should avoid sending highly sensitive information through ordinary electronic communication unless the method has been identified as appropriate for that information. Personal information is addressed further in our Privacy Policy.

16. Communication Boundaries and Response Times

Coaching does not include continuous monitoring, on-call medical availability, or unlimited messaging unless a specific purchased service expressly states otherwise.

Email, WhatsApp, website messages, and other communications may not be reviewed or answered immediately. Healthy Habits Coaching does not guarantee a particular response time unless expressly agreed in writing.

Healthy Habits Coaching has no duty to continuously monitor a client's condition, food intake, symptoms, glucose values, laboratory results, medications, messages, or other information between scheduled services.

A client who develops new, severe, worsening, or concerning symptoms is responsible for seeking appropriate medical or emergency care rather than waiting for a coaching response.

17. Appointments, Cancellations, No-Shows, and Refund Policy

Booking, cancellation, rescheduling, no-show, package, credit, and refund rules are governed by the Refund and Cancellation Policy presented in connection with the services and incorporated into these Terms by reference.

By purchasing or booking a service, you agree to the Refund and Cancellation Policy in effect and disclosed for that transaction, subject to rights that cannot lawfully be waived.

If a specific written service agreement contains a cancellation or refund term that conflicts with the general Refund and Cancellation Policy, the more specific written term applicable to that service will control to the extent permitted by law.

18. Prices and Payment

Prices and material payment terms will be disclosed at or before purchase. Unless otherwise expressly stated in writing, payment is due before the scheduled service.

You authorize charges that you knowingly approve through the applicable checkout or payment process.

You are responsible for providing valid payment information and for amounts properly due for services purchased or provided, subject to applicable law and the Refund and Cancellation Policy.

Healthy Habits Coaching may decline to schedule, begin, or continue a service when payment properly due has not been received.

19. Recurring or Automatically Renewing Services

Healthy Habits Coaching will not impose recurring charges unless the recurring or continuous nature of the transaction and material payment terms are disclosed and the authorization required by applicable law has been obtained.

If an automatically renewing or continuous service is offered, applicable price, billing frequency, renewal terms, material changes, and cancellation mechanisms will be disclosed as required by applicable law.

Where applicable law requires an online or same-medium cancellation method, Healthy Habits Coaching will provide the required cancellation mechanism.

20. Right to Accept, Decline, Suspend, or Terminate Services

To the maximum extent permitted by applicable law, Healthy Habits Coaching reserves the right to accept or decline a prospective client and to pause, limit, suspend, discontinue, or terminate a coaching relationship or service at any time, with or without cause and with or without providing a reason.

This discretion may be exercised, for example, when Healthy Habits Coaching believes that a client's needs are outside the appropriate scope of the service; medical evaluation or a different professional is appropriate; continuing the relationship may be unsafe or inappropriate; the client has provided materially inaccurate or incomplete information; payment is overdue; appointments are repeatedly missed; service boundaries are not respected; communications are abusive, threatening, harassing, discriminatory, fraudulent, or unlawful; the service is misused; or these Terms are materially violated.

The examples above do not limit Healthy Habits Coaching's right to discontinue services where otherwise lawful.

This provision does not authorize unlawful discrimination and does not eliminate any right or remedy that cannot lawfully be waived.

Financial treatment of unused prepaid services following cancellation or termination is governed by the applicable Refund and Cancellation Policy, specific written service terms, and applicable law.

Termination does not affect obligations that accrued before termination, including amounts properly due for services already provided.

21. Professional Referral and Discontinuation for Scope or Safety

Healthy Habits Coaching may recommend that you consult a physician, registered healthcare professional, mental-health professional, eating-disorder specialist, emergency service, or other qualified professional when your needs appear to require services outside the appropriate scope of coaching.

Healthy Habits Coaching may decline to provide or continue a recommendation until appropriate evaluation, clearance, or coordination occurs.

A referral or recommendation to seek other professional care does not create responsibility for the acts, omissions, availability, fees, or treatment decisions of an independent third-party professional.

22. Recording of Sessions

Coaching sessions may not be audio-recorded, video-recorded, screen-recorded, transcribed by an automated service, livestreamed, or otherwise captured by a client without prior express permission from Healthy Habits Coaching and any other person whose consent is legally required.

Healthy Habits Coaching will not intentionally record a private coaching session without obtaining any consent required by applicable law.

Unauthorized recording or distribution may result in immediate suspension or termination of services and may constitute a violation of intellectual-property, privacy, confidentiality, or other applicable rights.

23. Intellectual Property and Permitted Use

Unless otherwise indicated, original website content and materials created by Healthy Habits Coaching, including written materials, graphics, branding, educational resources, programs, worksheets, presentations, videos, and downloadable materials, are owned by Healthy Habits Coaching or used with permission and are protected by applicable intellectual-property laws.

Materials supplied to a client are licensed for that client's personal, non-commercial use unless expressly stated otherwise.

Without prior written permission, you may not reproduce, sell, license, publish, publicly distribute, commercially exploit, substantially copy, upload to a shared repository, or create commercial derivative materials from protected Healthy Habits Coaching content except where applicable law permits such use.

You may not use proprietary Healthy Habits Coaching materials or unauthorized recordings or transcripts of coaching sessions to train, fine-tune, evaluate, populate, or build an artificial-intelligence or machine-learning system without prior written permission.

Third-party trademarks, research papers, photographs, software, and other third-party materials remain the property of their respective owners.

24. Third-Party Links, Products, Professionals, and Resources

The website or coaching may refer or link to external websites, research articles, products, laboratories, apps, healthcare resources, professionals, or other third-party content.

A reference or link does not necessarily constitute endorsement, warranty, or guarantee.

Healthy Habits Coaching does not control independent third parties and is not responsible for their content, products, professional services, availability, pricing, security, privacy practices, decisions, errors, omissions, or subsequent changes.

You are responsible for evaluating whether a third-party product, service, or professional is appropriate for you.

25. Privacy

Collection and handling of personal information are described separately in the Healthy Habits Coaching Privacy Policy.

Please review the Privacy Policy before submitting personal information.

Acceptance of these Terms does not constitute consent to any collection, use, disclosure, or authorization for which applicable law requires separate consent.

26. Accessibility

Healthy Habits Coaching is committed to reasonable accessibility of its website and online services.

Accessibility practices and methods for requesting assistance or reasonable accommodation are described in the separate Accessibility Statement.

27. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, GENERAL EDUCATIONAL CONTENT, AND ANY NON-MANDATORY DIGITAL RESOURCES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS.

HEALTHY HABITS COACHING DOES NOT WARRANT THAT THE WEBSITE OR THIRD-PARTY SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF HARMFUL COMPONENTS, OR COMPATIBLE WITH EVERY DEVICE, SOFTWARE PRODUCT, OR THIRD-PARTY SERVICE.

NO WARRANTY IS MADE THAT USE OF THE WEBSITE, EDUCATIONAL CONTENT, OR COACHING WILL PRODUCE A PARTICULAR HEALTH, FINANCIAL, PERSONAL, OR OTHER RESULT.

Nothing in this section excludes a warranty, duty, or protection that cannot legally be excluded.

28. Assumption of Responsibility and Inherent Uncertainty

You acknowledge that decisions involving food, supplements, physical activity, weight management, and lifestyle may involve individual variability and may have unintended effects, particularly when medical conditions or medications are present.

You voluntarily decide whether to implement coaching information and remain responsible for observing your response, following applicable medical restrictions, and obtaining appropriate professional care when needed.

This section does not require you to assume risks created by conduct for which liability cannot lawfully be excluded or shifted.

29. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEALTHY HABITS COACHING AND ITS OWNER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, LOSS OF USE, OR SIMILAR REMOTE OR CONSEQUENTIAL LOSS, ARISING OUT OF OR RELATING TO THE WEBSITE, GENERAL EDUCATIONAL CONTENT, THIRD-PARTY PLATFORMS, OR SERVICES, EVEN IF THE POSSIBILITY OF SUCH LOSS WAS KNOWN, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

To the maximum extent permitted by applicable law, Healthy Habits Coaching is not responsible for loss or harm to the extent materially caused by a client's inaccurate, incomplete, misleading, or withheld information; failure to follow known medical restrictions; independent modification of medication; misuse of educational materials; unauthorized use of services; or acts or omissions of independent third parties.

Any liability that may lawfully be limited is limited only to the extent permitted by applicable law.

Nothing in these Terms waives, excludes, or limits liability that applicable law does not permit to be waived, excluded, or limited, and nothing requires a client to waive a non-waivable statutory or consumer right.

30. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Healthy Habits Coaching and its owner from third-party claims, liabilities, losses, damages, and reasonable costs arising from your unlawful misuse of the website or services, unauthorized commercial use or distribution of protected materials, intentional infringement of another person's rights, content or information you unlawfully provide or distribute, fraud, or material violation of these Terms.

This provision does not require you to indemnify Healthy Habits Coaching for liability that applicable law does not permit to be transferred to you.

31. Force Majeure and Events Beyond Reasonable Control

Healthy Habits Coaching will not be responsible for delay, interruption, or failure to perform to the extent caused by circumstances reasonably beyond its control, including natural disasters, severe weather, fire, epidemic or public-health emergency, war, terrorism, civil disorder, government action, utility failure, major internet or telecommunications outage, widespread platform failure, labor disruption, or other comparable events.

Where reasonably practicable, an affected scheduled service may be rescheduled, modified, or handled in accordance with the applicable Refund and Cancellation Policy and applicable law.

32. Changes to Services or Website

Healthy Habits Coaching may modify, replace, discontinue, or update website features, educational materials, communication methods, scheduling systems, or service offerings.

A material change affecting an existing paid service will be handled in accordance with the applicable written service terms, Refund and Cancellation Policy, and applicable law.

33. Changes to These Terms

Healthy Habits Coaching may update these Terms periodically to reflect changes in services, business practices, technology, or applicable requirements.

The revised version will display an updated "Last Updated" date.

Changes apply prospectively from their effective date unless applicable law permits otherwise. Material changes affecting an existing paid contractual relationship will be handled in accordance with applicable law and applicable service terms.

34. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles, except to the extent applicable federal law or mandatory law of another jurisdiction applies.

Nothing in this section deprives a consumer of a protection that applicable law does not permit the parties to waive.

35. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be interpreted, limited, or severed to the minimum extent necessary, and the remaining provisions will continue in effect to the extent legally permissible.

36. No Waiver

A failure or delay by Healthy Habits Coaching in exercising or enforcing a right or provision does not constitute a waiver of that right or provision. A waiver on one occasion does not constitute a waiver on another occasion unless expressly stated in writing.

37. Assignment

You may not assign or transfer your rights to individualized coaching services, appointments, account access, or obligations under these Terms without prior written consent from Healthy Habits Coaching.

To the extent permitted by applicable law, Healthy Habits Coaching may assign rights or obligations in connection with a lawful sale, transfer, reorganization, or succession of the business, subject to applicable privacy and consumer-protection requirements.

38. Survival

Provisions that by their nature should continue after termination will survive, including provisions concerning amounts properly due, intellectual property, restrictions on use, privacy obligations where applicable, disclaimers, limitation of liability, indemnification, governing law, severability, and any other provision intended to operate after termination.

39. Entire Agreement and Order of Precedence

These Terms, together with the Privacy Policy, Accessibility Statement, Refund and Cancellation Policy, and any applicable written service agreement, informed-consent document, checkout terms, or other expressly incorporated policy, constitute the applicable agreement concerning use of the website and services, subject to rights that cannot legally be waived.

If a specific written service agreement expressly conflicts with these general Terms concerning that service, the specific service agreement controls to the extent permitted by law.

If a specific Refund and Cancellation Policy applicable to a transaction conflicts with a general statement in these Terms concerning refunds or cancellations, the specific Refund and Cancellation Policy controls to the extent permitted by law.

40. Electronic Acceptance and Communications

Where permitted by applicable law, clicking an acceptance box, completing an online purchase or booking after being presented with these Terms, or otherwise electronically indicating agreement may constitute acceptance of these Terms.

You agree that legally permitted notices and transactional communications may be provided electronically using contact information you provide, subject to applicable law and your communication preferences.
